Coverage Under OPS in place of NPS who recruited against vacancies before 22.12.2003

Sub- Coverage under Central Civil Services (Pension) Rules (OPS), in place of National Pension System (NPS), of those Central Government employees who were recruited against the posts/vacancies advertised/ notified for recruitment, on or before 22.12.2003

Personnel Division  of Postal Directorate has issued an OM (No. 1-5/2023-SPG  Dated 14.02.2024) regarding Coverage Under OPS in place of NPS who recruited against vacancies before 22.12.2003. personnel division has recieved numerous representations for clarification on DoP&PW OM dated 03.03.2023 from Circles/ Regional Offices/ Divisional Offices/ Postal Accounts Offices/ other Units/ staff unions/ associations with respect to Group ‘B’ & ‘C’ officials/ staff and RTIs from general public are being sent/ transferred to this office referring to this section letter dated 09.03.2023.

In this regard, personnel division has informed that providing such clarification on an OM issued by Department of Pension and Pensioners’ Welfare does not fall under the purview of this section. Moreover, being cadre controlling unit of Indian Postal Service, Group ‘A’ officers, this section is not the nodal office to deal with the representations pertaining to Group ‘B’ & ‘C’ officials/ staff of this Department and staff of the PAOS of the Accounts cadre.

Personnel Division has also informed all the Circle/ Regional/ Divisional/ Unit heads/ PAOs  to dispose of any such representation at their end as per the conditions laid down in DoP&PW OM dated 03.03.2023 and clarifications, if any, may be sought directly from the Department of Pension & Pensioners’ Welfare through their respective Cadre Controlling Units/ Authorities.

Sub: Exemption of Railways from National Pension System (NPS) and restoration of Old Liberalized Pension Scheme in Railways-reg.
The Government of India had introduced New Pension Scheme (NPS) now known as National Pension System (NPS) w.e.f. 01/01/2004 which is contributory based and has been made applicable to those appointed/joined in Central Government Departments/Organizations from  01/01/2004. However, a few organizations/categories of Central Government employees were specifically exempted from the purview of NPS on consideration of special, riskier and more onerous nature of duties.
The National Federation of Indian Railwaymen (NFIR) has been urging upon the Railway Ministry since long that the Railway employees be exempted from National Pension System (NPS) as the nature of duties being performed by them are onerous, riskier and very complex like Armed Forces in the Country. The Railway Ministers Shri Mallikarjun Kharge and Shri Suresh Prabhu have considered the valid justification given by NFIR seeking exemption of Railways from NPS and had sent communications vide letter dated 29th March, 2014 and 12th November 2015 to the Finance Minister, Government of India to consider the case of Railways and grant exemption from NPS for restoring the Old Pension Scheme w.e.f. 01/01/2004. It is however unfortunate that the Central Government has not positively considered the proposals sent by two Railway Ministers. In this connection, NFIR mentions the role of Railways/Railwaymen as below in brief:-
During the British period, the Railways was conceived and operated as an auxiliary wing of the Army. It is an accepted fact that by virtue of its complex nature, the Railways require high level of discipline and efficiency to perform its role as prime transport mode. Indian Railways is an operational organization required to run round the clock on all the days under any circumstances. The Railway employees have to work in inhospitable conditions braving extreme weather, unfriendly law and order scenario and enhanced risk associated with the Railway operations itself. Like Armeti Forces, many Railway employees have to stay away from their families for long period while performing duties in areas where minimum living facilities are lacking. The nature of duties of Railway employees has been critical and complex while the hazards involved are also very high. The number of deaths of Railway employees in the course of performing duties is larger as acknowledged by the Chairman High Level Safety Review Committee (HLSRC) Dr. Anil Kakodkar in his report presented to the Railway Ministry, Government of India. Besides, large number of Railway employees lose their lives, while hundreds sustain serious injuries in the course of performance of their duties.. It needs to be appreciated that the nature of duties of Railway employees is inherently highly risky even during peace time, they also perform functions of critical importance during war times and times of natural calamities, in moving men and material across the country to maintain supply of essential commodities and safeguard the integrity of the nation.
The above mentioned valid grounds have been considered by the two Railway Ministers and felt that Railways should be exempted from National Pension System (NPS) as the pension outgo (Old Pension Scheme liability) is being met with by Indian Railways from its internal resources and there will be.no additional financial burden on the Central Government.
Hon’ble Prime Minister may kindly appreciate that the wages, allowances etc., of the Railway employees are met with through internal resources by the Ministry of Railways itself through its earnings generated by providing service to the customer. It is no exaggeration to place on record that the duties and responsibilities and accountability of Railway employees are akin to the Defence Forces of the country while hazards involved are also equal to the Armed Forces who safeguard the borders of our nation. Statistics reveal that on an average two Railwaymen get killed per day in the course of performing duties for ensuring services and the number injured/disabled while performing duties is very much on high side. Therefore, the Rail workforce deserve social security on par with armed forces duly restoring Old Pension Scheme in the Railways.
I trust that the Hon’ble Prime Minister would kindly consider the above merits and take steps towards exempting Railways from NPS and restoring the Old Pension Scheme.

Central Government Employee? NPS to Old Pension Scheme switch possible now – Check eligibility

Those Central Govt. employees whose selection was finalised before 01.01.2004 but joined after 01.01.2004 are being given a one-time option to be covered under the CCS(Pension) Rules, 1972.

          There is going to be a one time option for the central government employees to get coverage of CCS Pension Rules 1972, in place of the National Pension System (NPS). This will be applicable for those employees who were selected before 01.01.2004 but joined after 01.01.2004. The Department of Pension & Pensioners’ Welfare under the Government of India has issued an Office Memorandum (OM) recently thus giving an option to the impacted central government employees to opt for old pension scheme (OPS) instead of NPS.

The one time option will only be for those Central Government employees whose selection for the appointment was finalised before 01.01.2004 but who joined Government service on or after 01.01.2004. The OM makes it clear that subject to conditions, the one time option would be available to only those Government employees who were declared successful for recruitment before 01.01.2004, against vacancies pertaining to the period prior to that date.

After the introduction of National Pension System (NPS), all Government employees appointed on or after 01.01.2004 to the posts in the Central Government service (except armed forces) are mandatorily covered under NPS. The Central Civil Services (Pension) Rules, 1972 and other connected rules were also amended and were not applicable to the Government employees appointed to Government service after 31.12.2003.

However, the government had received representations from the Government employees appointed on or after 1.1.2004 requesting for the benefit of the pension scheme under Central Civil Services (Pension) Rules, 1972 on the ground that their appointment was delayed on account of administrative reasons or lapses.

As per the OM, it has now been decided that in all cases where the results for recruitment were declared before 01.01.2004 against vacancies occurring on or before 31.12.2003, the candidates declared successful for recruitment shall be eligible for coverage under the CCS(Pension) Rules, 1972

Accordingly, such Government employees who were declared successful for recruitment in the results declared on or before 31.12.2003 against vacancies occurring before 01.01.2004 and are covered under the National Pension System on joining service on or after 01.01.2004, are being given a one-time option to be covered under the CCS(Pension) Rules, 1972.

This option may be exercised by the concerned Government employees latest by 31.05.2020. All those who do not exercise this one time option by May 31, 2020, shall continue to be covered by the National Pension System.

Exists & Withdrawals under the National Pension System (Sixth Amendment) Regulations, 2019

PFRDA : (Exists & Withdrawals under the National Pension System) (Sixth Amendment) Regulations, 2019 
(I). Second and Third proviso to Sub regulation (b) of Regulation 5 shall be substituted as below-
Provided further that, where the accumulated pension wealth does not exceed one lakh rupees or a limit to be specified by the Authority, the whole pension wealth shall be paid without annuitisation to the subscribers who have not availed any Swavalamban co-contribution, and also to the subscribers who though have availed Swavalamban co-contribution but are not eligible for auto migration to Atal Pension Yojana, after deducting the Government’s co-contribution with returns thereon without requiring them to continue in the scheme for minimum period of twenty-five years.
Explanation— The migration of a Swavalamban subscriber to any other pension scheme of Government of India, including Atal Pension Yojana, as approved by the Authority, shall not be deemed as an exit and withdrawal for the purposes of these regulations.
