Subject: Migration of pending request of transfer under Rule-38 to online system.
Madam/Sir,
I am directed to refer to the above mentioned subject and say that during meeting held with all SPOCs on 21.07.2022 it has been reported by few Circles that transfer requests of earlier year not received by them earlier is found to be entered in data entry module. It is observed that non receipt of such requests were primarily due to non-forwarding by concerned outward Circle due to shortage of staff.
2. Transfer guidelines dated 17.01.2019 provides that request of those officials who fulfil all eligibility criteria for Rule 38 transfer as on 30th June shall be entered in outward register. Further it provides that o/o CPMG shall prepare Circle wise list of cases of inter-circle transfer and send to respective circle by 31st July requesting their accommodation report. Thus, the guidelines nowhere provides that forwarding of request seeking accommodation be withheld due to shortage of staff.
3. Therefore, it has been decided that all such earlier requests which were not communicated to concerned Circle for whatsoever reason and not received in inward Circle but entered in data entry module, shall be treated as received during June 2022 and would be allotted priority number in inward priority list as per prevailing instructions on the subject. Any grievance arising out of this shall be dealt by concerned outward Circle.
